Adrienne E. Nordstrom

Adrienne E. Nordstrom joined Clapp|Moroney in 1996, after serving as an associate at a Sacramento based litigation firm where she primarily handled the defense of construction defect actions. Adrienne was made a partner in April 2003 and has developed her own team in the firm’s Pleasanton Office specializing in construction defect litigation, complex litigation, mass tort action and real property actions, representing both large and small developers, general contractors, subcontractors, designers, materials suppliers and property owners throughout Northern California and the San Joaquin Valley. In addition to her significant litigation background, Adrienne has extensive experience in alternative dispute resolution practices including the use of creative and cost-effective non-traditional ADR methods to effect more timely resolution of complex litigation and claims.

As part of her practice, Adrienne has particular expertise in the relationship of insurance to construction-related matters, including working with clients with small and large self-insured retentions (SIR), handling litigation involving WRAP policies and policies with policy limits that are eroded by defense costs. Adrienne also has expertise in obligations to defend, tenders and indemnity issues. Her extensive knowledge of handling construction defect claims, involves a wealth of experience regarding plans, designs, specifications, and details which enables us to work effectively with design professionals. She has an understanding of complex design issues and is able formulate reasonable and realistic methods to address those claims. She is also cognizant of the challenges facing design professionals as is experienced in working with architects and engineers in various aspects of litigation as well as in business and transactional capacities. The applicable legal standards and issues relating to professional claims against design professionals are different than those claims against various contractors or subcontractors and are treated as such. It is vital that technical issues relating to design are analyzed from the viewpoint of the construction and business activities at the time of the design.

Adrienne and her team have had success in enforcing limitation of liability provisions, obtaining reasonable dismissals favorable to our clients, and utilizing claims for unpaid fees to successfully adjust settlement positions of opposing parties. We have defended design/build construction matters and have worked closely with design professionals under joint defense agreements to ensure a coordinated, efficient, and strategic defense of claims involving design professionals, developers and contractors. We are aware of the changes regarding design professionals liability and the duty and the cost to defend and work closely with our clients to account for such changes contractually. Our goal is to preserve the reputations of our clients. We provide advice and work to protect our clients from unfounded claims of negligence, errors or other allegations.

As general counsel, Adrienne and her team advise clients on legal issues and contracts; assist clients in the application and enforcement of contract terms, including construction managing issues relating to such documents and their implementation, code analysis, dealing with owners, design professionals and prospective purchasers, working with subcontractors and suppliers regarding lien and construction issues; analyzing insurance needs and coverage issues; advising on liability claims, professional liability claims and provide general legal support; and act as a liaison with outside counsel, developing legal strategy on behalf of the client.

Adrienne received her B.A. in Political Science with a Public Law emphasis from the University of California, Los Angeles in 1989, and her J.D. in 1993 from McGeorge School of Law. Adrienne was admitted to practice in California in 1993 and Colorado in 1996 and before the U.S. Court of Appeals for the Ninth Circuit, and the Northern and Central Districts of California. Adrienne is a member of the Alameda County Bar Association, the Contra Costa County Bar Association, the Association of Defense Counsel of Northern California and the Defense Research Institute.
